STEP 1 - CONTRACT APPLICABILITY

Please answer the following questions, and we'll let you know whether your contract/subcontract is exempt from CAS.

Is your organization a small business?

Your organization must be considered a small business concern per FAR 19.301-1

Is the awarded contract/subcontract a sealed bid contract?

Was the contract/subcontract price set by law or regulation?

Was the contract/subcontract price negotiated with the Government?

RFP/Solicitations that indicate they are subject to FAR 15 implies negotiation

What is the contract/subcontract award value?

Based on the Current Truthful Cost or Pricing Data Threshold (10 USC § 2306a)

Is the contract/subcontract a firm-fixed-price award?

Was the contract/subcontract awarded on the basis of adequate price competition?

A sole-source award is an example of a non-competitive award

Was certified cost or pricing data submitted?

Is the contract/subcontract authorized for the acquisition of commercial items?

RFP/Solicitations that indicate they are subject to FAR 12 are commercial

Is the contract/subcontract with foreign governments, their agents, or instrumentalities

Does not extend to contracts/subcontracts with foreign concern

Is your organization a subcontractor under the NATO PHM Ship Program to be performed outside of the US by a foreign concern

STEP 2 - COVERAGE TYPE

Please answer the following questions, and we'll let you know whether your award is subject to Full or Modified CAS-Coverage

Is the current award $50 million or more?

Has your business segment received $50 million or more in negotiated cost-type or negotiated firm fixed price awards valued over $2 million in the preceding fiscal year?

Has your business segment received a single CAS covered award of $50 million or more during the current fiscal year?

STEP 3 - DISCLOSURE REQUIREMENT

If you are subject to modified coverage, please answer the following questions to determine whether you must submit a Disclosure Statement.

Did your company, together with all segments, received $50 million or more in negotiated cost-type or negotiated firm fixed priced awards valued over $2 million in the preceding fiscal year?

Are the CAS covered awards of your business segment during the last fiscal year less than $10 million AND less than 30% of total business segment sales?
